$4.5 million mesothelioma lawsuit verdict not excessive, court finds


A California court has upheld a $4.5 million award in punitive damages to the family of a man who died from mesothelioma cancer. Justice Ignazio Ruvolo ruled that the compensation to the worker’s family was justifiable because of the “highly irresponsible actions” of his employer, ArvinMeritor.
The family of Gordon Bankhead filed the mesothelioma lawsuit against ArvinMeritor, alleging the brake manufacturer knowingly had employees handle products containing asbestos for nearly 30 years without providing any protection. Bankhead was diagnosed with mesothelioma in 2009 and died later that year.
Asbestos is a carcinogenic material that was widely used in construction and other industries until it was severely restricted in the 1970s. Asbestos exposure affects thousands of workers every year and is directly linked to several diseases, including asbestosis and mesothelioma.
